Welcome to Zeko. By accessing or using the Zeko website and marketplace (the “Platform”), you agree to be bound by these Terms & Conditions. Please read them carefully before registering or making a purchase.
1. About Zeko
Zeko is a South African online marketplace that connects independent craft makers (“Sellers”) with buyers (“Buyers”). Zeko provides the technology platform; individual sellers are responsible for their own products, fulfilment, and compliance with applicable law.
2. Eligibility
- You must be at least 18 years old, or have parental/guardian consent, to create an account.
- You must provide accurate, complete information when registering.
- You may not create an account on behalf of another person without authorisation.
- Accounts are personal and non-transferable.
3. Accounts and Security
You are responsible for keeping your login credentials confidential. Notify us immediately via the Help Centre if you suspect unauthorised access to your account. Zeko will not be liable for any loss arising from unauthorised use of your account.
4. Buying on Zeko
4.1 Orders and Payments
All prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable. By placing an order you make a binding offer to purchase the listed product. Your order is confirmed once payment has been successfully processed.
4.2 Shipping and Delivery
Delivery timelines and shipping costs are set by individual sellers. Zeko integrates with third-party couriers to provide estimates, but actual delivery times may vary. Risk of loss passes to you upon handover to the courier.
4.3 Returns and Refunds — Per-Product Policy
On Zeko, each seller sets a returns policy at the individual product level. Before completing a purchase, you will see one of two clearly labelled notices on every product page:
- Returns & refunds accepted — the seller accepts returns requested within 7 days of confirmed delivery, provided the item is in its original condition. To initiate a return, use the returns portal in your account dashboard or contact the seller via order messages.
- No returns or refunds on this product — the seller has indicated that the item is non-returnable (for example, custom-made, perishable, or personalised goods). This notice is shown prominently before you add the item to your cart. By completing the purchase you acknowledge this policy.
Regardless of the seller's policy, your statutory rights under the Consumer Protection Act, 68 of 2008 (CPA) are not affected. Items that are materially defective, unsafe, or not as described may always be returned under the CPA, even where a seller has disabled the general returns option. Zeko will intervene in disputes where statutory rights are engaged.
5. Selling on Zeko
If you register as a seller, you are also subject to our Seller Terms & Conditions, which form part of these Terms.
6. Prohibited Conduct
You agree not to:
- List or sell counterfeit, illegal, or prohibited goods.
- Misrepresent your identity or the nature of your products.
- Manipulate reviews, ratings, or search rankings.
- Use automated scraping or bots to access the Platform.
- Circumvent Zeko's payment system to conduct off-platform transactions.
- Engage in any conduct that could harm Zeko, other users, or third parties.
7. Intellectual Property
All content on the Platform, including logos, design, text, and software, is owned by or licensed to Zeko. You retain ownership of content you upload (product photos, descriptions, etc.) but grant Zeko a non-exclusive, royalty-free licence to display and promote that content on the Platform.
8. Disclaimer of Warranties
The Platform is provided on an “as is” basis. Zeko does not warrant that the Platform will be uninterrupted, error-free, or free of viruses. To the fullest extent permitted by law, Zeko disclaims all express or implied warranties.
9. Limitation of Liability
To the fullest extent permitted by applicable South African law, Zeko's aggregate liability to you for any claim arising from these Terms shall not exceed the greater of (a) the amount you paid for the relevant transaction or (b) R 500. Zeko is not liable for indirect, incidental, or consequential damages.
10. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with the Protection of Personal Information Act, 4 of 2013 (POPIA).
11. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the non-exclusive jurisdiction of the South African courts.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or via an in-app notice. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
